Father's Rights in Illinois

A legal myth exists that a father cannot walk into a court in Illinois and win a custody battle against the mother.  The reality is that the law in Illinois makes no distinction between the father and mother when evaluating custody.  Further, the father and mother of a child have equal rights in respect to the minor child.
 
Illinois has done away with the antiquated “tender years” doctrine, which gave preference of custody to the mother.  Rather, the Illinois courts evaluate custody by examining the best interests of the child.  Illinois statute lays out 10 relevant factors and Illinois case law has developed a litany of other factors.
